COSTILLA COUNTY — Two were arrested and a sheriff’s deputy injured during an incident that began with a burglar alarm going off in Rio Grande Ranches Monday afternoon.

At 1:16 p.m. on November 5, Costilla County Deputy Angela Esquibel was dispatched to 3782 Pecos Trail in the Rio Grande Ranches, Costilla County for a burglar alarm. Deputy Esquibel arrived on scene and contacted a male party.

After questioning the male and finally getting an identification, Deputy Esquibel was notified that Steven Marks, 53, had an active warrant out of El Paso County for domestic violence.

A struggle ensued between Deputy Esquibel and Marks during which a Taser was deployed with no effect. After a 30-minute struggle Deputy Esquibel was able to place Marks into custody with minor injuries to herself and Marks.

Timothy Withers, 69, who was on scene and refused to assist the deputy during the struggle, was also placed into custody after other agencies arrived.

Marks is being held at the Costilla County Jail for second-degree assault on a peace officer and other charges. Withers is being held for criminal attempt of second-degree assault on a peace officer.

Costilla County Sheriff’s Office would like to thank the Conejos County Sheriff’s Office, Colorado State Patrol and Colorado Department of Wildlife for responding to this incident.
