Costilla County lawman charged with a felony

SAN LUIS — A lengthy investigation into an inmate complaint some time ago yielded felony charges Monday against a long-time law enforcement veteran, according to Costilla County Sheriff Danny Sanchez.

An inmate some time back had accused Undersheriff Randy Herrera of excessive use of force, launching investigations by the 12th Judicial District Attorney, the county sheriff and the Colorado Bureau of Investigation.

It was established that the District Attorney found charges based on probable cause that the offense had been committed.

He is accused of restraining the inmate to a chair.

Sanchez said Herrera told him he would be resigning and “he is not employed at this time.”

He has been working in law enforcement in one capacity or another for some 30 years.
