Motions heard in double murder

DEL NORTE — A motion for change of venue has been filed by attorneys for Daniel M. Bessey, 43, who has been in the Rio Grande County Jail since January.

Bessey’s trial on an array of charges including two counts of first-degree murder has been set for 8 a.m. each day from Feb. 10 to 28.

Sarah Janay Beasley, 29, and John R. Salazar, 54, were killed Feb. 13, 2012, at the home they shared in Monte Vista. Bessey will be on trial for murder on Feb. 13, 2014, the anniversary of the deaths.

Deputy Colorado Public Defender Jill Allen filed a lengthy motion stating that a fair trial couldn’t take place in either the 12th Judicial District, where the murders took place, or the 10th Judicial District, where it is alleged that a large amount of “unfair pretrial publicity” had taken place.

A great deal of the publicity took place after the two bodies were found, and during the subsequent police investigation, although there have been some reports since Bessey’s arrest during Jauary.

Motions were heard Nov. 22 by 12th Judicial Chief Judge Patti Swift, who is expected to rule in December.
