ALAMOSA — Trial for homicide suspect Gregory Scott Carpenter has been set for April 5 and April 28 to May 2, 2014.
Chief 12th Judicial District Judge Pattie Swift set the dates, as well as some motion deadlines during a hearing in Alamosa District Court Thursday.
Carpenter is accused of shooting Jose Luis Fernandez to death on April 8, 2013, near his home in the Wagon Wheel Trailer Court.
During a hearing in September, defense attorney Matt Meuli told the court that Carpenter was citing the Castle Doctrine or “Make My Day” defense and filed a motion to defense based on that claim.
Swift denied that motion Thursday.
The 50-year-old Carpenter was not present in court and his attorney talked with the judge by telephone. He was unwilling to enter a formal plea without his client present, so the plea will be entered during a motions hearing at 11 a.m., Nov. 6. Deadline for motions will be Nov. 4.
