ALAMOSA — Visiting Senior District Court Jude Scott B. Epstein, retired from the Tenth Judicial District, will decide if any laws were broken in the Alamosa Board of Education (ABOE) sale of the Polston property to Dan Russell.
On Fri., Oct. 11, the matter between plaintiffs Keep Polston Public (KKP) and the defendants will come before the court in the form of a brief status conference, according to the Alamosa County District County review order. A date will also be set for a preliminary injunction hearing sometime during the week of Oct. 21 for up to one day.
In addition, counsel will discuss the contents of a joint hearing management order, according to the review order. Ninth Judicial District Judge Thomas Ossola, who was set to hear the case on Aug. 20, but did not due to Russell’s Aug. 14 request for extended time to prepare for the courtroom, previously called for the order following the hearing for a temporary restraining order (TRO).
