Charges filed in alleged Monte Vista stabbing case

DEL NORTE — A Monte Vista man accused of stabbing his son during an argument last month has been formally charged with an enhanced count of first-degree assault and felony menacing.

Judge Patrick Hayes, Jr., read the charges against John Marquez into the record during the defendant’s May 6 appearance in Rio Grande County Court.

The Class 3 felony offense of first-degree assault causing serious bodily injury carries a maximum potential penalty of 16 years in state prison, as well as a fine of up to $750,000. However, if the court finds that aggravating circumstances were involved, the prison term could double to 32 years.

The second offense of felony menacing is punishable by up to three years in state prison, along with a potential fine of $100,000. Under aggravating circumstances, though, the prison sentence for the Class 5 felony could double.

Police arrested the 50-year-old Marquez on April 28, following a report of an alleged stabbing at 668 Jackson St. in Monte Vista.

Officers arrived at the scene at about 10:30 a.m. that morning to find that Marquez’s 27-year-old son Jesse was suffering from a stab wound to his lower chest and upper abdomen.

Their investigation revealed that Jesse Marquez and his 50-year-old father were arguing in the moments leading up to the alleged assault.

The Monte Vista Ambulance Service transported Jesse Marquez to the San Luis Valley Regional Medical Center for medical treatment of life-threatening injuries.

John Marquez remains free on bail; his next court date is currently set for May 20.
