Carpenter argues self-defense in hearing

ALAMOSA — A hearing was held in Alamosa District Court to consider a motion made to dismiss the charges against Gregory Carpenter based on the Castle Doctrine, also known as the “Make My Day” defense, which maintains that a person is justified in using physical force to defend against an intruder.

Defense Attorney Matt Meuli argued that the April 8, 2013 shooting of Jose Luis Fernandez, 36, meets the standards required by Colorado State Law.

According to Meuli, the law provides immunity from prosecution if there has been an unlawful entry, and if the occupant has a reasonable belief the other person has committed, is committing or intends to commit in addition to the uninvited, and when the occupant reasonably believes that such other person might use any physical force, no matter how slight, against the residents.
